Accused dealer 'set trap': court

February 3, 2012

An alleged drug dealer has returned from his honeymoon to find himself facing new accusations including setting a rabbit trap intending to cause serious harm to a person.

Simon Alexander Kelly was bailed in the ACT Magistrates Court last month - the week before his wedding - on cannabis trafficking charges.

But when he reappeared in court today, the 29-year-old Latham man stood accused of two new trafficking charges, dealing with the proceeds of crime and setting a trap.

He has pleaded not guilty to all charges.

The office of the Director of Public Prosecutions has alleged Kelly was behind a "large criminal enterprise" selling methamphetamine and cannabis.

The court heard the case was based on information obtained through telephone intercepts and visual surveillance.

At his earlier hearing, the court heard Kelly had used a secret room behind his garage wall to grow a cannabis crop.

A cash-counting machine, scales and hydroponic equipment were discovered after police raided two homes in Canberra's north.

It is alleged they found $80,000 at the two properties.

The DPP asked Magistrate Maria Doogan today to impose tighter bail conditions on Kelly in light of the new charges.

But the man's barrister, James Lawton, argued his client had been on bail for weeks with no allegations of breaches or fresh offences.

Nevertheless, Ms Doogan said the new charges and expanded prosecution case changed the circumstances, and ordered Kelly to report to police three times each week.

He must abstain from using illicit drugs and submit to urinalysis when required.

In addition he has been banned from owning a mobile phone or leaving the country.
