Attorney-General Simon Corbell announced the ACT government would consider three of five reforms to legislation recommended in an information paper released by the Justice and Community Safety directorate on Tuesday.

Double jeopardy is the common law rule that a person can't be prosecuted a second time for an offence if they have already been acquitted.

Under the proposed changes, retrials of serious cased after an acquittal would be allowed where fresh and compelling evidence emerged or if it could be proved the trial was tainted.

People cleared of offending could also find themselves back in court for administration of justice offences that questioned the acquittal.

The laws would be called upon in "limited circumstances" and only for the most serious of crimes which carried a maximum sentence of life in prison, Mr Corbell said.

The government knocked back a proposal outlined in the paper that would allow prosecutors to appeal against a ruling on the admissibility of evidence where the ruling substantially weakened the prosecution case.

It also rejected a suggestion that a retrial be allowed on the basis of an error of law in any jury or judge-alone trial.

The announcement follows a long-term push by the Director of Public Prosections and ACT Victim Support for changes to double jeopardy legislation, which have met resistance from the ACT Human Rights Commission and civil liberties groups.

Mr Corbell said any new laws needed to strike a balance between the rights of victims and community community safety and the rights of an alleged offender and the double jeopardy rule.

He said similar laws introduced in Australia and overseas had rarely been used.

"The government will ensure that adequate safeguards are in place to allow for potential injustice to be remedied in a small number of cases."

Mr Corbell said national and international changes to double jeopardy laws had cleared a path for the ACT to consider reforms.

"The proposals have been developed following extensive consultation with stakeholders over several years, including the Human Rights Commission, and I am very confident that any changes will meet the requirements of the ACT's human rights legislation," he said.

The DPP called for the reforms to the ACT's double jeopardy laws in a discussion paper in 2010.

There is currently no mechanism in the territory to allow a retrial when new evidence is available through technological advances, or where the defendant has perjured themselves, deliberately misled the court or bribed a key witness, the paper said.

It said most other Australian jurisdictions included a number of exceptions to double jeopardy to allow retrials in limited circumstances when there was an error of law, where new evidence is available, or where the person was acquitted through fraudulent or underhanded means.

Mr Corbell will introduce the proposed reforms to the Legislative Assembly in 2016.
