The detainee was still at large a day after his accidental release, and prosecutors believe he has used his newfound freedom to contact his alleged victim.

The mistake occurred after Scott Alan Insull, 41, came before the ACT Magistrates Court on Wednesday for allegedly attacking his partner the day prior.

He applied for bail, and told the court of a Sydney address he could stay at during the court proceedings, to help keep him away from the ACT.

Prosecutors, however, asked the court for time to check out the Sydney address, ensure it was legitimate, and that Insull would be welcome there.

The bail application was delayed, and Insull was supposed to be kept in custody until prosecutors made inquiries.

Instead, for reasons unknown, he was simply released.

It is unclear who is at fault for the accidental release, or how it occurred.

Prison authorities are understood to have no record of him ever arriving at the Alexander Maconochie Centre.

The case was urgently relisted in the ACT Magistrates Court on Thursday, where the prosecution told the court of the mistake, and advised that Insull was still at large.

The court heard it had been a condition of Insull's bail that prosecutors check the Sydney address prior to his release. Those checks were not complete at the time of Insull's release. They have now been done, and those living at the Sydney address say they do not want Insull there, the court heard.

A warrant has now been issued for his arrest.

Insull was arrested and held in custody for offences that allegedly occurred on Tuesday.

Court documents allege he choked his partner twice and repeatedly punched her in the face.

The first time he choked her, police say, the woman began to feel dizzy, felt the blood rushing to her head, and her vision became blurry.

Later, he allegedly shoved her with his elbow, causing her to fall back and lose consciousness.

He is accused of pushing her onto the bed and choking her, to the point where she thought she was going to die, before letting go and allegedly slapping her in the face.

Insull is alleged to have stabbed her tyres with scissors and punched her repeatedly in the head.

She eventually ran to the Lanyon markets and called police.

Insull was brought before the ACT Magistrates Court the next day, and Magistrate Beth Campbell said she would only consider bail if he had an address outside the ACT to reside at.

Prosecutor Anna Jamieson-Williams told the court on Thursday that Insull was only to be released once the Sydney address had been checked.

"In the meantime, unfortunately Mr Insull has been released on bail and he is currently at large," she said.

Magistrate Robert Cook on Thursday found Insull was in breach of the bail conditions.

"That condition hasn't been met and he's been released contrary to that requirement, so a warrant should be issued."

Bail was revoked and a warrant has been issued for his arrest.
