ACT Human Rights commissioner Helen Watchirs and Winnunga Nimmityjah chief executive Julie Tongs are just two of the many voices calling on the government to implement such a position.

Barbara Causon, chair of the ACT steering committee reviewing Aboriginal and Torres Strait Islander children in protection, said within the first two meetings of the newly-formed committee, the idea of introducing an Indigenous commissioner had been raised.

"We're not at the point where we could say, yes we're definitely going to recommend that, but it's certainly something that is under consideration," Ms Causon said.

Dr Watchirs said the ACT Human Rights Commission "strongly supports" the move to give the Indigenous community greater rights to self-determination.

"The ACT Human Rights Commission recognises the significant levels of disadvantage and discrimination experienced by Aboriginal and Torres Strait Islander peoples in our community, and the concerning over-representation of Aboriginal and Torres Strait Islander peoples in our criminal justice and child protection systems."

Dr Watchirs said the commission would support any opportunity for high level Indigenous leadership to bring change in the ACT, but added it was essential to include Aboriginal and Torres Strait Islander people in the decision making process, particularly in what would be an appropriate model for such a commissioner in the territory.

Ms Tongs said the introduction of an Indigenous Commissioner would help the jurisdiction which continues to "drag its feet" when it comes to the oversight of child protection services in particular.

"It is disappointing that the ACT government doesn't pay greater attention to the vulnerable in our community," Ms Tongs said.

"The government needs to shift their thinking and their funding into early intervention. Early intervention will cost in the short term however it will deliver long term benefits."

Ms Tongs said the ACT was the only jurisdiction that doesn't have an Aboriginal and Torres Strait Islander child care agency.

"Aboriginal organisations and people have the solutions to the problems impacting on our community however we are often by-passed and funding goes to services who don't or can't deliver," she said.

"Winnunga Nimmityjah Aboriginal Health and Community Services and Gugan Gulwan Aboriginal Youth Corporation are constantly picking up the pieces of broken lives when we are not resourced to do this."

ACT Public Advocate and Commissioner for Children and Young People Jodie Griffiths-Cook is also calling for the change.

In Victoria, a commissioner for Aboriginal children and young people was appointed in 2013. Andrew Jackomos' role was to focus on reducing the high number of Aboriginal children in the justice system or at risk of abuse. While the position is currently vacant, in the five years the commissioner's role has been in place it has made a huge impact on the way the Victorian system addresses systemic issues in the Indigenous population, according to Michael Bell who worked closely with Mr Jackomos.

Victorian Aboriginal Children and Young People's Alliance chairperson Mr Bell said the appointment of the commissioner five years ago brought Indigenous and non-Indigenous community organisations together to provide better outcomes for the Indigenous community.

"It really created a conversation and helped develop good strategies in addressing concerns that were raised," Mr Bell said.

He said the ACT should consider such an option.

"The significant over-representation of Aboriginal children in out of home care is a national issue and to have a commissioner who can report directly to the Legislative Assembly [in Canberra] and report back directly is a clear way of getting the issues put on the table and obviously that influences the way budgets are developed," Mr Bell said.

A spokeswoman for the ACT government said discussions on the implementation of such a role were being "broadly canvassed" but no decision would be made until after a review of the Human Rights Commission, which would start in April 2019.

"A formal proposal to establish a new Commissioner role within the Human Rights Commission would need be considered in the context of structure as a whole. We anticipate a proposal of this kind will would involve significant consultation to identify appropriate functions and funding," the spokeswoman said.

"The ACT government is committed to ensuring that the interests and views of Aboriginal and Torres Strait Islander people living in the ACT are equally represented and considered."
