The amendments, tabled in ACT Legislative Assembly on Thursday, would allow police to use recorded interviews as evidence in court and redefine strangulation, creating a lower threshold for the offence having occurred.

The changes would also allow a magistrate to extend an interim domestic violence order when related criminal charges were unresolved before the court.

"Domestic and family violence affects one in six women and one in 19 men in Australia every year," Mr Corbell said.

"In the ACT, we have recently had painful and confronting reminders of this statistic.

Mr Corbell said the reforms had been drafted in consultation with community experts, frontline workers, victims of domestic violence in Canberra.

"I had the opportunity to speak to a woman who had lived through serious domestic violence," he said.

"She spoke about her experiences of the ACT justice system and highlighted the significant problems that she faced when attempting to secure a domestic violence order."

Mr Corbell said the ability to extend domestic violence orders would protect applicants and respondents when a further application was made involving both parties.

The bill would also include the offences of stalking, burglary and aggravated burglary under the definition of a serious violent offence.

Mr Corbell said allowing police to use recorded interviews as evidence would reduce the trauma caused by testifying in court and improve accuracy.

In April, Mr Corbell said the Director of Public Prosecutions had recommended introducing a lesser charge of strangulation as it would help prosecutors in domestic violence matters.

"To strangle a victim is a very common action we see in domestic violence, particularly against women," he said.

Under existing provisions, the prosecution must prove beyond reasonable doubt that strangulation was so severe that the victim lost consciousness or was rendered insensible.

"The amendment seeks to recognise the seriousness of strangulation by creating an offence with a lower threshold than endangering life," Mr Corbell said.

"This reflects the evidence that strangulation is a tactic often used in family violence to threaten, intimidate and control a victim."

Mr Corbell acknowledged the amendments would limit the human rights of family violence perpetrators.

"The government believes that the limitations are proportionate and justified in the circumstances because they are the least restrictive means available to achieve the purpose and to protect the human rights of others – in this case, women, children and their families," he said.
