Keith Dutton, 45, of Wilcannia, was sentenced on Friday in the ACT Supreme Court after pleading guilty to a charge of sexual intercourse without consent.

The court heard the victim had finished grocery shopping at the Canberra Centre when Dutton approached her and asked for a cigarette, before offering to carry her groceries to a Braddon apartment complex.

He then talked his way into the woman's flat and offered her drugs once inside.

Dutton left briefly to return with another man and spent the evening boasting of his criminal history, including telling the victim he had once been shot by police after taking his family hostage.

When the other man fell asleep, Dutton demanded sex and forced the woman to give him oral sex for 10 minutes.

She reported the incident to police the following day.

A previous sentencing hearing heard the victim had mental health issues, including panic attacks, and lived in fear after the assault.

A victim impact statement detailed the woman pulling over her car to vomit from nerves at leaving her home.

Her teenage son, who was at home at the time of the attack, had moved interstate and began carrying a knife as a result of the incident.

But the woman was also defiant, pledging to regain control of her life and not let the incident define her.

Chief Justice Terence Higgins sentenced Dutton to five years' jail, backdated to take into account time served, with a non-parole period of three years.

"One can only say the victim would have been in considerable terror … wondering what [Dutton] would do next," the judge said.

Justice Higgins said the offence was aggravated by the fact it had taken place in the woman's home.

"Women are entitled to be protected in their own homes," he said.
