Craig Lynch, the defence lawyer for two people accused of bashing Queanbeyan father Andrew McInnes so badly he suffered a stroke, told the Queanbeyan Local Court on Friday that CCTV footage of the incident had been provided to NSW prosecutors.

But police were yet to supply the defence with the recording or the medical reports for the two alleged victims.

Mr McInnes, 40, is undergoing rehabilitation as a result of injuries he suffered during an alleged attack at Walsh's pub in Queanbeyan on August 9.

Daniel Keith Charnock, 29, Rebecca Smith, 38, and Matthew Darrol Davis, 30, have been charged over the incident and appeared in the Queanbeyan Magistrates Court on Friday.

Charnock, who is in custody, has been charged with three counts of grievous bodily harm, two counts each of common assault and affray, and assault occasioning actual bodily harm.

Smith, Mr McInnes's ex-wife, is accused of three counts of inflicting grievous bodily harm, affray and common assault.

Davis faces three charges of grievous bodily harm, assault occasioning actual bodily harm and affray.

A fourth man, Josh McMahon, has been charged with three counts of common assault and affray in relation to the same incident.

He did not appear before the court on Friday.

Court documents said the bitter marriage split between Smith and the Mr McInnes last year had led to a number of alleged disputes and threats, which also involved Davis.

Mr McInnes was with a friend, a 40-year-old Jerrabomberra man, at the pub about 11.50pm when Davis allegedly attacked them.

Davis is accused of first knocking out the friend, who fell to the ground and hit his head and elbow, with one punch, before punching Mr McInnes twice.

Police allege Davis had been pulled away when Charnock elbowed and punched the alleged victim in the head.

Court documents said Davis then allegedly tackled and punched Mr McInnes, before Smith allegedly kicked him in the head several times as he lay helpless on the ground.

Davis and McMahon then allegedly threatened security staff with a beer bottle and a bar stool before fleeing.

Mr Lynch, defence lawyer for Smith and Davis, told the court on Friday that police had provided him with a brief of evidence and had since agreed to hand over the medical reports.

But they refused to supply the footage.

The lawyer said it could be viewed at Queanbeyan Police Station, which meant a barrister would be forced to travel from Sydney to properly prepare a defence case.

Mr Lynch said the fact NSW prosecutors had been given the footage put the defence at a disadvantage which was "unfair" for his clients.

He indicated he may make an application to have the footage released.

The matter was adjourned until November
