But Thiago Tonti Fanti, 36, has not yet been charged over the incident that put Navjot Sekhon and Kyah ''Burma'' Han in hospital.

Fanti had been summonsed to appear before the court on a charge of culpable driving causing grievous bodily harm.

But the prosecution withdrew the count and told the ACT Magistrates Court on Thursday that police were working on creating a driving charge to accurately reflect the offending.

Defence lawyer Peter Woodhouse, of Ben Aulich and Associates, indicated Fanti’s intention to plead guilty when formally charged.

Police will allege the Harrison man was behind the wheel of a ute that hit the two victims as they walked home through Braddon after a night partying in Civic in February.

Mr Sekhon and Mr Han were both hospitalised as a result.

Mr Han was airlifted to a Sydney hospital for specialist care for his a broken neck and spine, and brain injury.

Mr Sekhon suffered only minor injuries and was released from the Canberra Hospital shortly after.

CCTV footage shows the ute being driven along Henty Street in Braddon, apparently looking for the pair, who were hidden from view.

Fanti will reappear later this month.
