Justice Richard Refshauge’s decision means Dylan Deblaquiere and Daniel McDonald will stand trial before the ACT Supreme Court in August on charges of using a carriage service in an offensive manner.
McDonald is also accused of committing an act of indecency on a fellow cadet, who was 18 at the time.
In February, the two accused formally entered pleas of not guilty when they were arraigned to stand trial.
Lawyers for the pair applied to have the proceedings permanently stayed but the request was on Thursday rejected by Justice Refshauge.
Justice Refshauge declined to publish the reasons because the trial is listed to begin on August 19.
