Kristy Louise McGuckin, 31, was released on Tuesday following an out-of-court bail hearing in the ACT Magistrates Court.

Police said in a media statement they used capsicum spray on the defendant.

They had responded to reports of a disturbance at Centrelink in Tuggeranong about 12.45pm, and say the woman was aggressive and came toward them with clenched fists.

She was arrested and taken to the ACT Watch House, before being charged with trespass, assault, resisting police, and affray. Magistrate Bernadette Boss bailed her to reappear on July 2.

McGuckin's placement in the Alexander Maconochie Centre has previously raised concerns among magistrates.

She has significant mental health issues, but has been held in custody in the past becausethe absence of a secure forensic mental health unit in the ACT.

McGuckin has also previously caused some difficulties for the courts in unrelated matters.

In May 2013, she appeared in court fully restrained and flanked by five guards, two of whom were wearing helmets.

Court staff were forced to conduct another bail hearing while McGuckin was in the back of a prison van in the loading garage beneath the courthouse.

The court had repeatedly sent her to hospital for mental health assessments, but staff refused to admit her.

A secure mental health facility is being constructed.
