Robert Azbajic, the owner of Rob's Spit Shack, east of Braidwood, said he felt powerless when dealing with the Palerang Council over health and safety regulations, and lodged an official complaint.

Mr Azbajic, who emigrated from Croatia in 1989, even wrote to Prime Minister Tony Abbott in April alleging he was discriminated against and threatened.

But Palerang Council general manager Peter Bascomb said the allegations were false and Mr Azbajic's business did not comply with planning requirements.

"Mr Azbajic's complaint was fully and formally investigated," he said. The investigation found that there was no basis for Mr Azbajic's complaints.

"Council staff were simply trying to work with Mr Azbajic to ensure compliance with planning requirements and he was treated no differently to any other operator."

The small kebab store was Mr Azbajic's "life ambition" and he had built a reputation as a popular stopping point for Canberrans driving to the south coast in warmer months.

On a busy day, the small store would sell around 500 kebabs or nine pork legs and two lambs.

Mr Bascomb said an inspection in late June had identified several areas of non-compliance although a follow-up inspection did not occur due to the closure of the business.

Mr Azbajic believes his store was treated differently to other mobile stores in the area – a claim Mr Bascomb rejected.

"Mobile food and drink outlets do not require development consent from council because they are exempt development under State Environmental Planning Policy," Mr Bascomb said.

"Mr Azbajic's operation included a number of additional structures and facilities that meant that it could not be considered to fall within the definition of a mobile food and drink outlet.

"These included a separate cooking apparatus, cool room, toilets and a covered veranda."

In April, staff at the store wrote to Mr Azbajic and said they would have no choice but to resign unless the portable toilets removed by the council were replaced.
