The National Capital Authority and the takeaway have entered into an agreement allowing the business to continue trading until June 30 next year.
Gaby’s Takeaway is located next to York Park in Barton, next to the Department of Foreign Affairs and Trade and the Department of Communications as well as the Minter Ellison building.
The stall has been operating under a temporary trader permit allocated on an annual basis.
"It's a reasonable outcome for both parties," the stall's owners, the Wilk family, said.
"At this stage we're still not sure what the future has to offer but hopefully everyone will come to visit us before we leave."
Gaby’s Takeaway was advised five years ago a temporary traders' permit would be allocated on an annual basis, and future works were planned for the site.
NCA chief executive Malcolm Snow said the owners had requested more time to make other arrangements for their business.
"In considering the request, we determined the current works planned for the site could be staged around the extended permit arrangement," Mr Snow said.
"Landscape enhancement works on Windsor Walk will continue this financial year as planned, however sufficient area will be retained around the takeaway to enable the owners to trade in the short term."
The takeaway was originally established to service the needs of construction workers in the area, the NCA said. Much of this construction work was now complete.
There were also more than 10 other cafes and restaurants in the area, each of which paid rent.
The takeaway has been serving Canberrans for almost 30 years.
Owners Gabriel and Monica Wilk, now in their early 50s, moved to the area from Argentina so Gabriel could play soccer for a club in Queanbeyan. Instead of returning home after two years they instead set up the takeaway and became Australian citizens.
The shop sells nachos, chicken schnitzels, hamburgers and salads and has fed the full gamut of bureaucracy, from graduate public servants to department heads.
