Jason Bosley launched an unfair dismissal case against Kosciuszko Thredbo - which runs the ski resort - in the Fair Work Commission on the grounds he had been fired illegally.

Mr Bosley argued he had a verbal contract that he would be employed at the winter resort for the 2017 season.

However, Thredbo said Mr Bosley could not be sacked because he was not an employee at the time of his alleged dismissal.

The matter came before Fair Work Commission deputy president John Kovacic in June.

The commission heard Mr Bosley had been a full-time seasonal employee of the Thredbo ski patrol team for the previous 13 winters.

The contract of employment for 2016 had run from June 11 until October 3, but could be terminated earlier, with "adverse climatic conditions" listed as possible causes.

In September, Mr Bosley and other ski patrol staff were given notice that the season would end on October 3.

Mr Bosley worked one additional day on October 4, to assist in packing up before then flying to France the following month to work the northern hemisphere winter.

In December, he received an email from his ski patrol manager to notify him that he would not be re-employed for the 2017 season or future seasons.

Mr Bosley launched the legal action in January, arguing that as he worked on October 4, his seasonal contract had become an ongoing contract and therefore Thredbo was required to provide him with notice of termination as per his employment contract.

He said he had received no notice of termination.

He also told the FWC that at the conclusion the 2016 seasonal, that his manager had said to him words to the effect "see you next year and we will do this all again" which he considered to be a new verbal contract for continuing employment.

But Thredbo, in response, said no one was hired on the basis of a verbal agreement or a handshake, and the ski resort required applicants to submit a formal employment application, with applicants then selected for interview.

Thredbo said Mr Bosley's employment ended on October 4 and that there had been no decision to sack him, but rather it decided not to re-employ him, therefore his employment had not been terminated.

Thredbo also claimed Mr Bosley had been given notice of termination and there was no evidence that his contract of employment had continued beyond October 4.

Deputy president Kovacic, in a decision published last week, found Mr Bosley had not been sacked and threw the case out.

"The material before the Commission in this case does not point to any act on the part of [Thredbo] which resulted directly or consequentially in the termination of Mr Bosley's employment.

" To the contrary, the material before the Commission points to Mr Bosley's seasonal employment being extended by agreement by one day and simply coming to an end on 4 October 2016.

"This supports a finding that there was no dismissal at the initiative of the Respondent.

"I find that Mr Bosley was not dismissed. Accordingly his application is not competent and must therefore be dismissed."
