Don't lose sleep over what needs to be done to repair the slow motion train wreck that has been the Section 44 saga now threatening to take down deputy Prime Minister and Nationals leader Barnaby Joyce.

The most important question that needs to be addressed right here and now is whether or not the Coalition Government is legitimate.

That is the core issue facing the electorate in what is shaping up to be the most serious crisis facing this government to date.

If, as many believe, Mr Joyce should stand down as deputy prime minister, relinquish his multiple portfolios and resign from the house of representatives after being outed as New Zealand citizen - by that country's Prime Minister no less - then it isn't.

The Government's one vote lower house majority would cease to exist.

It wouldn't be possible to determine who was the party of government until a by-election was held for the seat of New England, a constituency which has a strong tradition of voting independent and whose former member, Tony Windsor, turns a youthful 67 on September 2. That couldn't be done overnight.

Mr Windsor, for the record, has not ruled out running again in the event Mr Joyce is forced to quit.

While the situation may become even more complex given the possibility more MPs on both sides of politics may also be found to be in breach of Section 44, as matters stand the fate of the Turnbull Government rests on what the High Court rules in regard to Mr Joyce.

Mr Turnbull displayed a remarkable degree of confidence in his ability to foretell the future on Monday when he told the parliament: "The Deputy Prime Minister is qualified to sit in this house and the High Court will so hold".

This confidence, we are told, is based on advice from the Solicitor General that the Government has been unwilling to make public.

Given the Prime Minister's unqualified assertion the High Court will rule in the Coalition's favour appears to undermine the separation of powers and that the question of whether he or Bill Shorten is the legitimate leader of the country is at issue this reticence is remarkable.

If the Government is so sure it is in the right it should make all the facts supporting this stand public immediately.

Mr Joyce believes he is still eligible to serve in Parliament, rather than follow the precedent set by Greens Senators Ludlam and Waters and resign, he needs to do more to make his case to the Australian people. What is now clear as that the Coalition will fight tooth and nail to avoid that possible outcome - the fate of the entire government could depend on it.
