QUESTION:

I have received conflicting views on transferring some share parcels into my wife's name via off market transfer.

My accountant says the transfer price must be the market price on the day.

My broker says I can transfer them at any price I nominate.

Who is correct?

ANSWER:

They are both right – you can transfer them at any price you wish, but for capital gains purposes the price will be deemed to be the market value on the date of transfer.
