ACT Labor Senator David Smith will stand by a staffer accused of bullying until after the matter can be probed, saying it is critical that internal processes be conducted without prejudice.

Senator Smith said he would take action at the conclusion of the investigation if required but that complaints should be kept confidential.
"It is critical in workplaces and party forums that we all treat each other with civility, fairness and respect and that we have regard to fair process," he said.
A complaint containing the allegations against Senator Smith's media adviser Nick Douros and Young Labor members Niall Cummins and Francis Claessens was filed with ACT Labor last week with the matter referred to the internal disputes tribunal for investigation.
The group told The Canberra Times they would cooperate with the investigation, with Mr Cummins claiming the complaint was politically motivated.
According to the complaint, the group allegedly labelled an office bearer of the youth arm of the party a "rat" and plotted to "bully the f--- out of her" to force her to resign her position after the construction union ordered its members to join the left faction.
The complainant, who said the group's behaviour left her with anxiety and feeling socially isolated, said it seemed the men assumed she would defect.
She alleged they had committed numerous contraventions of the ACT Labor code of conduct including intimidation and harassment, coercive behaviour intended to be derogatory or intimidating, offensive messages on social networks, and isolation or exclusion from normal social activities.
Chat transcripts show Mr Cummins allegedly asked "are we able to roll [the woman] off [Young Labor] or are we stuck with her".
Mr Douros, also the president of ACT Young Labor, allegedly responded: "Tbh we can just bully the f--- out of her until she does" and called her "weak".
She was later allegedly removed or prevented from accessing six online groups, including the official Young Labor social media and email account, and ordered to resign from her position.
Senator Smith said he was first alerted to the complaint in The Canberra Times.
"If, as a result of that process there are further actions that need to be taken then I will take action at the conclusion of the investigations," he said.
Mr Douros said on Monday: "It is still inappropriate for me to comment at this stage.
"The internal process is being undertaken and they need to be followed."
