A man accused of urinating on a woman in a Civic laneway after she refused to perform a sex act with him has been granted bail by the ACT Magistrates Court.
The court heard Danny Subasic, 21, of Giralang, had consumed so much alcohol and cocaine that he did not remember meeting the woman at the Academy nightclub in the early hours of Monday morning.
Detective-Sergeant Hall O'Meagher said the pair left the club at about 5am and were in the process of engaging in consensual sex in a nearby laneway, when Subasic attempted to anally penetrate the woman.
The court heard that when the woman resisted, Subasic punched her a number of times and, when she tried to run away, tripped her over.
He then allegedly held her against a wall and urinated on her as she screamed for help.
Sergeant O'Meagher said a male member of the public came to the woman's aid, allowing her to escape, but that Subasic assaulted him too.
Two more passers-by went to assist and called police, who arrested the young painter.
Sergeant O'Meagher told the court the woman was upset over the unprovoked attack.
''The [alleged] victim is extremely traumatised in relation to the incident and if the defendant was released on bail that would increase her fear and further traumatise her.
''If his alcohol and drug use goes unchecked there is a chance he may engage in this behaviour again.''
Magistrate Peter Dingwall said the accusations were serious and, if convicted, Subasic would likely go to prison. But he said there was no indication the young man would interfere with witnesses, and granted him bail on conditions including that he stay away from Civic and Braddon, and not go out at night.
Subasic is due to reappear in court next month.
