But the board has set a deadline of Friday for Mr Jones to accept the offer as the parties remain at loggerheads over a decision to stand Mr Jones down last month.

It is hoped the parties can meet behind closed doors to thrash out a deal without being dragged through a court case.

It comes after the board organised a rival meeting to a scheduled extraordinary general meeting last week which displayed a divide among the Canberra club rugby ranks.

The Canberra clubs hold 14 of 23 votes in the Brumbies boardroom, but half went to the extraordinary general meeting with Mr Jones while the other half met with the board at Tuggeranong last Thursday.

It's understood the board has been trying to organise a meeting with the Wests, Easts and Royals officials that failed to attend the meeting last week to give their side of the story. There was speculation that the parties were meeting on Wednesday night.

The board has been mulling over its options for the past five days after Mr Jones rejected the payout they tabled at a meeting last week.

The latest offer would still include a payout, but involves bringing in an independent mediator to help the aggrieved parties negotiate a deal. Mr Jones said last week he wanted to continue as the Brumbies' chief executive.

Mr Jones believes he has done nothing wrong and wants to continue in his role after Justice Richard Refshauge ruled in his judgement that the "dominant factor" in the board's decision to stand him down stemmed from Mr Jones making public interest disclosures.

Mr Jones took the Brumbies to court seeking whistleblower protection last month and the Brumbies failed in their bid to dissolve an injunction.

The case appeared again in the ACT Supreme Court on Wednesday, at the request of lawyers for the University of Canberra, former deputy chief minister David Lamont and Joe Roff.

Mr Jones' lawyers failed to file a statement of claim, a document which sets out its case, by the date set by the court. They were told it must be filed by Thursday afternoon, and were made to pay costs for Wednesday's proceedings.

Part of the claim will be kept secret, to prevent breaches to existing suppression orders over the contents of the KPMG report into irregularities with the Brumbies' Griffith headquarters sale and move to the university.

Jones' lawyers told the court they were committed to the principle of open justice, and took no position on the suppressions, which drew a rebuke from Justice Refshauge.

He reminded them they were the ones who first asked for the KPMG report to be suppressed.

"I think it's not appropriate to trumpet open justice too loudly when the non-publication orders came from your side of the bar table," he said.

The Brumbies squad is in New Zealand preparing for a game against the Highlanders as they continue their fight to resurrect their Super Rugby season after losing three of their past five games.
