The legal stoush over the proposed redevelopment of the shops first began in 2011, when then Planning Minister Simon Corbell used call-in powers to approve the construction of a large Woolworths, retail outlets, restaurant, and car parks.

An alliance of Canberra businesses, including nearby supermarkets, were highly critical of the decision.

The case went all the way to the High Court, which found partially in the opponents' favour, giving them standing to fight the decision in court.

It found the operators of the Supa Express supermarket at Kaleen and the IGA supermarket at Evatt were "persons aggrieved" by Mr Corbell's decision, overruling the ACT courts decision not to allow them to stand in the matter.

The landlord of a Kaleen supermarket, however, had his appeal dismissed by the High Court.

The case, which has now returned to the ACT Court of Appeal, appeared on Wednesday.

Lawyers for the opponents said there were new court decisions they needed to consider that related to the Giralang stoush.

That included a decision in the planning battle over the proposed Gungahlin mosque, started by controversial group the Concerned Citizens of Canberra.

The court gave the parties until May to write submissions on the new relevant cases, and the matter will not return to the ACT Court of Appeal until early June.

Representatives for the ACT Government Solicitor opposed any further submissions on the case, saying there was just not an "academic concern" about delay and uncertainty.
