The club opened its doors to a government audit in June amid questions about the state of its finances, which appeared less-than-healthy despite a record $8 million sponsorship deal with casino multinational Aquis.

It has since described its financial position as solid, although it is not expected to make a profit in 2016.

The government has recently received the audit report, and says it is considering the findings.

A spokeswoman for Sports Minister Yvette Berry said the government had not yet decided whether the report would be released publicly.

"A decision on whether the report, in whole or part, will be publicly released will be made only after the government discusses the report with key stakeholders including the Brumbies and the ARU," she said.

The audit came during a tumultuous time for the club. It was locked in a bitter stoush with chief executive Michael Jones, who raised serious questions about a land deal involving its former Griffith headquarters and a new site at the University of Canberra.

Mr Jones used the territory's whistleblower protection laws to allege he had been unfairly treated after disclosing serious irregularities with the deal, taking the club and others to the ACT Supreme Court, a case that has since been settled.

A KPMG report at the centre of that case - said to detail concerns about the land swap deal - remains suppressed by the ACT Supreme Court.

The audit was also taking place in the background to concerns about two of the club's sponsors. There was a significant breakdown in relations with the University of Canberra, a sponsor and partner, and the club feared that its major sponsor Aquis may back out of the agreement if the casino didn't get the go-ahead for poker machines.

The Canberra Times has pushed for many months for access to information about why the government waived the $7.5 million lease variation tax on the Brumbies land in Griffith when the lease was changed to allow Graham Potts's Amalgamated Property Group to build apartments there.

Questions have been raised about whether the tax break went to the Brumbies, as announced by the government, or whether it instead benefited a private developer.

Mr Barr approved the tax waiver in September 2012, just days before the caretaker period for the 2012 election.

In May this year, the Canberra Times made a Freedom of Information request for all information on the tax waiver since 2007. The government first delayed its response for consultation with "a third party" and then to give the third party an extension of time, eventually sending a decision on July 28. The decision listed but didn't identify 100 documents held by the Environment and Planning Directorate and nine documents in the Chief Minister, Treasury and Economic Development Directorate. But it said given "ongoing legal matters that directly or indirectly relate" to the issue, it had decided to defer release for three months.

On August 2, the Canberra Times requested a review of the decision, pointing out that there was nothing in the Freedom of Information Act relating to legal processes impacting release of information, and seeking clarification about what legal processes the government was referring to.

The answer, on September 6, from Planning Directorate deputy director general Gary Rake, said the decision to defer had been made because it would not be in the public interest to release documents that could impact on legal proceedings.

As to what legal proceedings could be impacted, Mr Rake said the government had contacted police in June to determine whether they were investigating allegations related to the land deal.

Those communications "did not rule out the possibility of future investigations", he said.

"While we do not have confirmation of any investigative proceedings at this point, on the basis of the potential impact the release of documents could have on future investigations, I have determined the responsible course of action is to uphold the original decision to defer access until after 31 October 2016," Mr Rake said in September.

On October 26, the directorate advised that it had recommenced considering the application.

"Every effort is being made to finalise processing as a priority, however we do need to wait for the third party to confirm their representation in regard to potential impact on their business affairs," the directorate said.
