Members of ACT Health's clinical cultural committee in February 2016 discussed sharing employee information of those who lodged bullying complaints or those who were the subject of investigations with the Australian medical regulator, Australian National University and medical colleges, documents have revealed.

The committee brought in a government solicitor to see if the measure was feasible, with the solicitor stating clauses could be inserted into contracts to allow information sharing to occur.

It is not known if the measure would have applied solely to new employees signing contracts or would be added in to all employees' contracts retrospectively.

According to minutes of the meeting, obtained under freedom of information laws, the committee said there was difficulty with the pre-existing complaints process.

It was proposed the private information related to bullying complaints would be shared with parties ACT Health considered relevant to investigations.

The third parties would include others within ACT Health, Calvary Hospital, the Australian Health Practitioner Regulation Agency, ANU - where many ACT Health employees had studied or were doing postgraduate work - and medical colleges.

"In relation to overcoming privacy issues in sharing information about complainants, this can occur providing clauses are inserted into employee contracts," the documents said.

"The information must be provided up front in the employment discussion and be agreed to by the employee.

"In addition, it must be explicitly in relation to breaches of contract with regards to staff misconduct to fall within the legislative exemptions."

The committee was established in November 2015 and has been meeting monthly, after being a recommendation from a damning KPMG report into cultural failings in the ACT health system, with widespread bullying and harassment reported.

At the time the information-sharing measure was proposed in early 2016, the committee's members included then-ACT Health director general Nicole Feeley, who was absent during the February discussion.

The February meeting had 11 senior ACT Health officials present.

A Canberra Health Services spokesman said the recommendation from the government solicitor was never enacted.

"No clauses have been inserted into employee contracts about sharing complaint information with third parties," the spokesman said.

"ACT Health and Canberra Health Services do not share information relating to complaints or misconduct investigations with third parties.

"To do so would breach privacy legislation and risk compromising the investigation process."

In its February 2016 meeting, the committee said while information about bullying complaints would be shared between parties, it would not be made public.

"Information about the complaints, or their results, cannot be published or reports made public," the meeting minutes said.

"Investigations would be compromised if both proponents and third parties privacy is compromised."

Health employees have previously expressed concerns about bullying investigations within Canberra's hospitals, with those who make bullying complaints often having the investigation turn on themselves.

Bullying, harassment and staff culture issues within the ACT public health system is set to be examined as part of an independent review.

The review, chaired by former Queensland Health director-general Michael Reid, will hand down its final report to the ACT government in March, with an interim report expected in January.

In its first meeting in November 2015, the clinical cultural committee discussed creating an anti-bullying statement, another key recommendation of the KPMG report.

However, work has stalled on the statement, with only a draft created in 2017 after consultation with several groups.

The committee also proposed in 2016 a communication strategy aimed at eliminating inappropriate behaviour in the workplace, which had a two-year timeline to implement. Work on the strategy has not progressed.
