Supreme Court Justice Soraya Ryan last month ordered the colourful businessman's civil case, which involved bizarre claims a federal MP mailed him a boxing glove as a threat over his refusal to sell land on the Gold Coast to a church, be set aside and the statements of claim be struck out.

Mr Palmer and his company Palmer Leisure Coolum had lodged a civil claim in the Supreme Court asking for criminal proceedings before the Magistrates Court to be permanently stayed.

The Queensland mining magnate and PLC were charged by the Australian Securities and Investments Commission over an unfulfilled 2012 proposal to buy shares of another company, The President's Club, that owned properties at his Sunshine Coast resort.

Mr Palmer had argued the ASIC charges were brought for an improper purpose and "doomed to fail".

In a decision handed down this week, Judge Ryan ordered Mr Palmer and PLC pay the legal costs for the Commonwealth Director of Public Prosecutions and ASIC.

The first defendant in the case, the Magistrates Court of Queensland, did not seek costs.

The CDPP and ASIC had argued Mr Palmer's case was "misconceived, futile and an abuse of the processes of the court".

"The plaintiffs [Mr Palmer and PLC] were put squarely on notice of these deficiencies and on two occasions were invited to discontinue on a 'walk away' basis," they submitted.

The plaintiffs wrote to Mr Palmer and PLC in November to say they would bear their own "significant costs" if the case was discontinued.

However, PLC's lawyers argued the offer was made at a time when the case had only been running for less than two months, costs at that stage were likely not substantial and the defendants did not estimate what their costs were at that stage.

Judge Ryan ordered Mr Palmer and PLC pay costs for the CDPP and ASIC but not on an indemnity basis which would have meant a higher payment.

Judge Ryan said that she found the case was an inappropriate attempt to interfere with the criminal process and there was nothing truly exceptional to warrant intervention by the Supreme Court but it was not necessary for her to make findings about Mr Palmer and PLC's motives in bringing the case.

"The accusations made against ASIC and the CDPP by Mr Palmer were serious and, as I found, groundless," she said.

"It was not possible for me to conclude whether those accusations were made in bad faith, without conviction, simply for the purposes of delaying the committal proceeding or whether Mr Palmer genuinely believed he was the victim of the conspiracy he alleged."

Court documents revealed a series of bizarre claims by Mr Palmer, including a "co-ordinated, targeted campaign" against him by the Australian government, featuring a "whiteboard in Canberra", on which MPs plotted ways they could get him.

Mr Palmer alleged LNP member for Fadden Stuart Robert had repeatedly asked him to sell a $6 million slice of Gold Coast land to his church, and even sent him a boxing glove in a box as an apparent "threat" if he did not agree to the sale.

A spokesman for Mr Robert said the claims were "ridiculous" and the minister did not "believe they warrant a response".

Mr Palmer had argued the ASIC charges were politically-motivated and it was in the interests of LNP members for him to be convicted of an offence punishable by jail for one year or longer, as he would be disqualified from seeking election at the upcoming federal election.

The ASIC charges are still before the Magistrates Court.

Mr Palmer has announced his revamped United Australia Party will run candidates in all 151 lower house seats at the upcoming federal election.
