It was one of several cases highlighted in Anti-Discrimination Commission Queensland's annual report for 2017-18, tabled in Parliament late Friday afternoon, which showed impairment and sex discrimination were the most common grounds for discrimination complaints across the board.

Citing examples of complaints successfully conciliated, the commission reported the incident in which the HIV-positive man booked an appointment to receive direct hair implants.

“The complainant’s initial treatment was postponed, but he was later told that the clinic did not provide hair implantation service to HIV-positive patients, due to the risk of needle stick injury,” the commission reported.

The resolution involved the respondent agreeing to provide expert training on blood-borne viruses for staff, writing an apology to the complainant, and paying financial compensation.

Other cases included a female council worker, who was told to watch porn on a co-worker’s phone and then “shake his hand and sort it out” when she complained, and a man of north African descent who was subjected to racist nicknames.

More than 43 per cent of complaints received were for discrimination against impairment, and 11 per cent were about race. Sexual discrimination complaints increased to 13 per cent.

Out of those complaints, 137 were referred to the Queensland Industrial Relations Commission or the Queensland Civil and Administrative Tribunal, up from 103 the year before.

The commission saw a 26 per cent increase in overall complaints, with the majority from the south-east Queensland region, however, that number included all complaints lodged online.

In total, the commission finalised 818 complaints in the past year, up from 700 in 2016-17 and 625 the year before.

Four complaints of whistleblower reprisal were accepted.

Another case involved a female labour-hire worker who joined a council’s parks and gardens section.

On her first day, she alleged a co-worker continually bragged about his sexual conquests, asked the woman to go out with him, spoke in a derogatory sexual way about other female employees, and told the woman she should ‘feed, f--- and leave’.

“He also grabbed the complainant’s shoulders when she told him to stop touching her, told the complainant and another worker to look at porn on his phone, and finally, that he ran around in a public park ranting that the complainant had accused him of raping her,” the commission reported.

The woman complained to her hire agency who raised the issues with the council.

“She was then told by two supervisors that she had to make amends to the individual respondent, sit with him at lunch if he requested it, and to shake his hand and sort it out,” the commission said.

While the council was required to pay compensation and write an apology to the woman, and arrange anti-discrimination training for specific employees, the woman chose not to settle with the individual respondent but was considering referring him to the Tribunal.

In another incident, a worker of north African descent was given derogatory nicknames including “frog”, “boat person” and “Borat”, and sexually harassed.

That case resulted in training for 250 staff on the Anti-Discrimination Act, and further apologies and compensation made to the man.
