The Honourable Justice Julie Dodds-Streeton QC will hand a review to ACT Attorney-General next month on how new laws stemming from the Royal Commission into Institutional Responses to Child Sexual Abuse impact on the confessional seal.

The ACT's parliament in June voted to extend the territory's reportable conduct scheme to the confessional, despite concerns about the law's impact on religious freedoms.

The provision will take effect after March 31 and would require religious organisations to report allegations, offences or convictions related to children to the ACT Ombudsman within 30 days, even if the information was gleaned under the seal of confession.

The $185,000 review is being paid for from the criminal assets fund, which redistributes cash from the sale of confiscated assets.

A Justice and Community Safety Directorate spokeswoman said Justice Dodds-Streeton will provide advice on how best to implement the relevant recommendations in a manner that is consistent across different reporting obligations, and takes account of constitutional law and human rights considerations.

Justice Dodds-Streeton has been asked to consult directly with a range of organisations most affected by the reforms, including churches and agencies responsible for the operation of existing reporting schemes.

She will also meet with representatives of organisations representing survivors of child sexual abuse.

"The analysis report will identify any legal issues associated with the proposed reforms, and options to resolve or mitigate them, to meet the object of requiring reporting of information obtained from the confessional," the spokeswoman said.

However the spokeswoman said there were no plans at this stage to push back or scrap the extension of mandatory reporting to the confessional. She said the government would decide whether to release the review early next year.

Canberra and Goulburn Catholic Archbishop Christopher Prowse publicly warned the government not to ignore the concerns of the Catholic community the day before the legislation was passed.

He said while the government said it wanted to consult religious groups on the laws, the legislation was being debated before his planned meeting with the Attorney-General took place.

"The government threatens religious freedom by appointing itself an expert on religious practices and by attempting to change the sacrament of confession while delivering no improvement in the safety of children," Archbishop Prowse wrote in an opinion piece for The Canberra Times in June.

"Sadly, breaking the sacred seal of confession won’t prevent abuse and it won’t help our ongoing efforts to improve the safety of children in Catholic institutions."

The Australian Catholics Bishops Conference also wrote to ACT Chief Minister Andrew Barr in July warning children would be "less safe" because of the laws.

"Were trust in the absolute confidentiality of confession undermined then any chance a victim would mention this in confession to a priest would also be seriously diminished; any chance a priest-confessor might have to impress upon the victim the need to inform responsible adults outside confession and get to safety would also be lost," the letter read.

However the directorate spokeswoman said they were unaware of any intended legal challenge to the reform.

The ACT government accepted or accepted in-principle 290 of the 307 recommendations made by the royal commission. It noted or took under further consideration the remaining 17.

The territory has introduced tranches of legislation this year in response to the royal commission, including making it a crime to fail to protect a child from sexual abuse in institutions and tightening up sentencing in historical abuse cases.

A progress report released on the one-year anniversary of the royal commmission's final recommendations being handed down also flagged more civil and criminal law reforms in 2019.

The government will make changes to the Working With Vulnerable People Scheme to bring it in line with other jurisdictions.

Work is also under way to find an an appropriate model for an ACT intermediary scheme, which allows speech therapists, psychologists, teachers, social workers or mental health workers to help vulnerable witnesses communicate in court.
