The 413-page Motor Accident Injuries Bill was tabled in the Legislative Assembly late on Tuesday, 18 months after a citizen's jury on the topic was first announced.

While the draft legislation is designed to give anyone injured in a motor vehicle accident access to medical treatment, care and lost income regardless of whether they were at fault, drivers convicted of serious offences will have their benefits revoked or reduced.

Those offences include murder, manslaughter, intentionally inflicting grievous bodily harm, wounding or culpable driving.

They also include drink and drug driving, as well as refusing to provide a breath, oral fluid or blood test.

However Canberra's high concentration of diplomats - and their record of using their diplomatic immunity to avoid prosecution over driving offences - has led the ACT government to introduce measures that would allow the new Motor Accident Injuries Commissioner to revoke their entitlements, should they use the Vienna convention to avoid criminal charges.

The commissioner must consider the official accident report and any other evidence provided by police in making their decision, which will be open to review through ACAT.

An insurer can also request the commissioner cancel the diplomats' benefits.

"This provision of the bill aims to ensure that diplomats who engage in criminal behaviour but cannot be prosecuted are not better off than Canberrans who are unable to claim such immunity," a spokeswoman said.

The removal of benefits from criminals is intended to be a disincentive to people who engage in serious illegal behaviour or put others at risk.

Their benefits won't be removed until they have been found guilty or convicted, meaning an injured person can still receive care and treatment until that point. Any quality of life payment application will be placed on hold until the charges are finalised.

There will also be no requirement for criminals to pay back the entitlements they received if they are convicted.

People who are in jail awaiting trial for their charges though will not be able to claim treatment and care benefits. This is because they can receive care for their injuries from Justice Health and Corrective Services.

Foreign nationals will also be able to claim treatment, care and income replacement benefits while they are in Australia, however they cannot apply for quality of life benefits.

They can apply however for a lump sum of up to $10,000 when they leave Australia for future income replacement and treatment needs.

Meanwhile lawyers in Canberra remain concerned about the move away from the current, common law system of compulsory third-party insurance.

In a joint statement, the presidents of the ACT Bar Association Steve Whybrow, and the ACT Law Society Chris Donohue, as well as the ACT director of the Australian Lawyers Alliance Jamie Ronald said the amendments negotiated by Greens and the unions did nothing to alleviate the unfairness of the scheme

"It is alarming that the government seems to have the support of the ACT Greens on the basis of a few faux amendments that will do nothing to alleviate the unfair and unjust outcomes that will flow from the proposed scheme," they said.

"If this legislation is passed, this Barr government-Greens deal will slash the benefits and rights Canberrans currently have – all for a measly $14 annual reduction in their insurance policy.

"When you add in the costs of creating and staffing a whole new division of the ACT Civil and Administrative Tribunal, and establishing a new bureaucracy to manage the scheme, it is likely there will be no net gain to Canberrans at all."

However a government spokeswoman said the updated costings - which were an estimate only - had factored in the cost of the new ACAT division.

The ACT Law Society has also hit out at the futility of having a quality of life payment of $350,000 for people with a whole person impairment of 100 per cent, where no-one will qualify for the payment.

They have described the decision to exclude superannuation from gross income as "arbitrary" and the gaps in the legislation as "significant" .

However the government spokeswoman said the combination of quality of life damages with unlimited treatment, care and income replacement benefits means payments for people with a serious injury could be significantly higher than $350,000.
