Educators will also have to inform the Teacher Quality Institute if their Working With Vulnerable People card lapses or is suspended, changes Education Minister Yvette Berry says will make Canberra's schools safer.

Ms Berry tabled the bill to strengthen reporting requirements to the ACT's Teacher Quality Institute in the Legislative Assembly on Thursday.

Anyone who wants to teach in the ACT must be registered by the institute and must meet its strict criteria.

But as it stands, the institute does not have the power to seek information from schools when making a decision about a teacher's registration.

Industrial relations and privacy laws have also prevented schools from providing the institute with information about teachers' conduct.

"There have been situations in the past where employers have notified the institute of a situation but not given it any or sufficient further information," Ms Berry said

"In other cases, employers have finished a formal investigation and all due processes before letting the institute know about an issue, or a teacher has resigned during the investigation and the investigation is cancelled."

This has meant the institute has been unable to make an assessment about the teacher's registration status.

This may mean the teacher is free to work in another ACT education sector or another jurisdiction despite the potential risk to children, the bill's explanatory statement said.

Asked whether such a situation had occurred in the ACT, Ms Berry's spokeswoman said the government was unable to confirm either way because the employer of each teacher is not tracked.

Under the changes, schools would be obliged to inform the institute when they begin an investigation against a teacher.

The institute would also be able to request the identity of the teacher, a description of the alleged event and any details of the investigation.

"The change will ensure that a teacher’s registration status is also subject to scrutiny in these circumstances alongside other protective frameworks," the spokeswoman said.

"The registration status of a teacher who resigns in the midst of an investigation will be assessed to determine if there is cause to cancel, suspend, or impose conditions on their registration. It may, depending on the circumstances as assessed by the Teacher Quality Institute, prevent a teacher from moving to another school."

The bill would also require teachers to maintain a current Working With Vulnerable People card while employed and to inform the institute if their status changes.

While teachers must have a card when they're hired and when their registration is renewed, it could be possible for a Working With Vulnerable People qualification to lapse between registration.

"These improvements will help the institute to make sure that only suitable people can teach in our schools," Ms Berry said.

The bill will also enact recommendations of the Royal Commission into Institutional Child Sexual Abuse and the Glanfield Inquiry, commissioned after the murder of nine-year-old Bradyn Dillon.

The ACT Education Directorate director-general would be able to share information about a child's enrolment status with other jurisdictions, to ensure children taken out of ACT schools are still involved in the education system.

The government will also set new criteria for the registration of non-government schools..

The current criteria and conditions do not provide non-government schools or proposed non-government schools with clarity on what is required for registration, or which matters must be addressed in their policies and procedures, such as the child safe standards recommended by the royal commission.

The laws will be debated when Parliament resumes in the new year.
