Dr Phelps said she would juggle the two political roles, splitting her time between Sydney and Canberra, as votes for the eastern suburbs seat continued to be counted on Thursday.

"I've spoken with the [Sydney City council] CEO about meeting those commitments and that would be my intention," Dr Phelps said in Canberra.

However, she would not be drawn on whether she would publicly release the legal advice she sought to ensure she was eligible to sit in federal Parliament under section 44 of the Constitution.

"I satisfied myself by doing my homework before I nominated that I didn't have section 44 issues and that's my position today," she said.

Questions over Dr Phelps' eligibility revolved around whether her council role and job as a practising GP, who received Medicare payments, put her at odds that section of the law.

It bans people from sitting in Parliament if they earn money from taxpayer funds.

Dr Phelps will earn up to $39,540 for staying on the council, and pick up almost $200,000 a year while she divides her time in Canberra.

She was elected to council as the first on the ticket of Cr Moore's group of independents in 2016 and had served as deputy mayor until she dramatically quit that team last June.

There has also been speculation about how Dr Phelps might manage the demands of two electorates.

Former federal MP Philip Ruddock, who was elected Hornsby mayor after years as a Howard government minister, said this week he had spoken with Dr Phelps about the demands of each role.

"If you are going to do the job properly, there are exceedingly heavy demands; the demands are insatiable," he said.

Dr Phelps reiterated her first priority as a federal MP would be getting children off Nauru.

"It is just not acceptable that these children who are in extremely poor condition many of them -- one in four are suicidal -- are left trapped on Nauru withour proper medical attention they need," she said.

The Australian Electoral Commission has not yet declared the result in Wentworth.

Dr Phelps led Liberal candidate Dave Sharma by 1720 votes on Thursday afternoon, and is on 51.1 per cent of the two-candidate preferred vote.
