Last week, the ACT Greens called for increased notice periods for tenants before they could be kicked out of a rental property.

Greens housing spokeswoman Caroline Le Couteur said there should be a 12-week notice period for people who, through no fault of their own, received notices of eviction.

Currently, a tenant must be given four weeks notice if the landlord, or a family member, intends to move into the property and eight weeks notice must be given if a landlord intends to sell the property. Twelve weeks notice must be given if the landlord intends to rebuild or renovate the property and landlords cannot do so while someone lives there. Twenty-six weeks notice is required if the landlord wishes to end a periodic tenancy without cause.

Ms Le Couteur said the proposal to require a 12-week notice period, except in exceptional circumstances, would provide good renters a reasonable buffer of time to ensure they could find a new place to live. She said the proposal would ensure landlords that intended to move in must apply for an exemption if they believed only four weeks notice was required.

A spokeswoman for ACT minister Gordon Ramsay said the government was committed to making sure vulnerable people had the protections they need in the rental market. She said the Greens' proposal was an important area of the government's legislation.

"We are already looking at this issue in the context of our comprehensive work on improving the security and affordability of rental properties, and delivering a strong housing strategy for the ACT," the spokeswoman said.

"Recognising that there are all very different situations, it is important to thoroughly consult on changes to the required notice period for each and we will do that."

She said the government was consulting with tenants' rights advocates, the Real Estate Institute and the broader community.

"We have been consulting on fair notice periods and will continue to do so, and importantly we will focus on ensuring that tenants are not unfairly stuck with fees and rental obligations in these situations," she said.

The ACT Tenants Union's Deb Pippen supported the Greens' proposal, and said her organisation had been making a similar call for years. She said it was much harder for people in the tight rental market.

"I think this is why the Greens have made this push, also that the different time frames are unjustifiable and unfair and the results are more significant in a tight market when people cannot find a new home in four weeks or eight weeks," Ms Pippen said.

"These time frames result in stress and hardship. People are forced into taking properties that are not appropriate and or they can’t sustain in the long term."

The ACT Real Estate Institute declined to comment.

The government will introduce legislation to bring forward more and stronger protections for renters before the end of this year.
