An ACT Auditor-General's report last week found the winner of the tender, the CFMEU-linked Tradies Club, was awarded the contract to buy the land, despite government making significant changes to the original request for tender in the final deal.

The audit showed the value of the changes meant the club benefited from "significant concessions" valued at up to $2.6 million, in a raft of changes that were not offered to the broader market when the tender was advertised.

That audit and its findings is now being further examined by the Legislative Assembly's public accounts committee, which officially launched an inquiry this week and has called for submissions.

The deal saw the club agree to buy the carpark land outside its Dickson club for $3.5 million, with settlement at a date yet to be determined, in return selling the government two of its blocks of land in nearby Section 72, Dickson, for $3.9 million and $49,500, respectively.

While the club told auditors the impression it "may have received favourable treatment" was "unequivocally wrong"; the audit office ultimately found the government sold the carpark block [Block 30, Section 34, Dickson] "on favourable terms" to the club.

It also showed that the government solicitor's office believed the terms of final sale had differed so significantly from the original RFT that it was essentially a "direct sale".

The government solicitor's office also told the public servants running the tender that the economic development directorate should have reissued a new one, or sought Cabinet approval for the deal.

Neither course of action was taken at the time, and due to the concessions given to the club, including the removal of a termination clause from the final contract, it is unclear on what grounds the contract could be terminated.

The only other company to put in a tender to buy the land [Block 30, Section 34, Dickson], was a Woolworths subsidiary, Fabcot Pty Ltd.

A spokeswoman for Woolworths has now confirmed the supermarket giant was still interested in potentially purchasing the block.

"Woolworths can confirm that when the property in Dickson was tendered in 2012 we believed it was ideally located to enhance our offer to the local community and that view hasn't changed," she said in a statement.

But Woolworths would not comment further on what other steps it might consider taking in relation to the tender process in light of the audit report's findings, given it was the only other tenderer for the purchase.

Planning Minister Mick Gentleman said last week that the report "puts the matter to bed" and that it found no evidence of wrong-doing by public servants or politicians, despite such findings being outside the scope of the Auditor-General's remit.

Both Opposition leader Alistair Coe and Greens leader Shane Rattenbury have indicated the matter could be referred to the ACT's proposed anti-corruption commission, the operations of which the government this week indicated would be delayed at least until mid-2019.

The public accounts committee inquiry, which started on Thursday, has called for submissions to be lodged by Friday April 13.

Mr Gentleman this week declined to answer questions, instead referring them to planning directorate director-general Ben Ponton, who said the government would give "robust consideration" to the report.
