Diverse Security Group (DSG) has been reported to the Fair Work Ombudsman over alleged breaches of the Fair Work Act.

The company has worked at recent ACT football matches and at Floriade's Nightfest last year under head contractor SNP Security.

A spokesman for the ombudsman confirmed they received requests for assistance this year in relation to DSG.

They could not comment further as enquiries were under way, but sources have alleged to Fairfax Media that DSG last month moved staff onto a flat rate of pay and had not paid them superannuation for the period of their employment.

Fairfax Media has seen payslips from employees that said their superannuation fund details were "pending", even though the employee had provided them previously.

DSG has not responded to requests for comment.

Casual security guard Tom* said he once worked 106 hours in a fortnight for DSG and was paid a flat rate of $19.80 an hour.

He contested it and the company bumped up his pay for that period to a flat rate of $25 per hour - still without penalty or overtime rates.

Tom was also paid $25 an hour in cash for working more than 12 hours at a music festival.

He believed many guards were reluctant to speak up about it because a lot of security workers did it as a second job.

"Tax on second jobs is pretty high and I have no doubts they take advantage of it," he said.

Tom has also lodged a complaint with the Australian Tax Office after finding no super had been paid into his account from DSG.

His payslip said 'fund details pending' despite him submitting them with his employment documentation when he started work.

"It was the same form they make you put your next of kin on so I remember it, I know they've got it," he said.

The accusations come as DSG hired the former owner of another security company being probed by the ombudsman - Shane Tipa.

Last month the Fair Work Ombudsman revealed it had launched enquiries into claims guards at Mr Tipa's company, Phuture Security, were underpaid for work at ACT government events.

Mr Tipa strenuously denied the claims and Fairfax Media has not seen payslips that prove otherwise.

On April 26, Mr Tipa moved to voluntarily deregister the company, ASIC has confirmed.

A voluntary deregistration requires a declaration that no outstanding liabilities exist, including employee wages, and making a false declaration to ASIC is an offence.

Mr Tipa is now a manager with DSG, and through a statement said he had not yet been contacted formally by Fair Work or any former employee claiming any money was owed.

"Once Mr Tipa accepted employment with Diverse Security Group Pty Ltd it took some time to ensure that all debts and creditors had been paid by the company known as Phuture Security Pty Ltd," his statement said.

"In consultation with the company's accountant, when all creditors of the company had been paid, the company was deregistered as it was no longer trading. That was the responsible thing to do with a company that is no longer trading and has no creditors."

Prior to the merger, guards from both companies were subcontracted by SNP Security, the company which holds the actual contract with the ACT government.

From September to March, the ACT government paid SNP about $580,000 for security at events like the Keith Urban concert, the one day international cricket match as well as Canberra Raiders and GWS Giants games.

SNP's events contract allows for subcontracting with the permission of the ACT government.

A spokeswoman for SNP said they were transparent with all their customers and gained their consent regarding the use of subcontractors.

But the ACT government said last month they had not received any such request.

SNP said it did its due diligence to ensure subcontractors were being paid properly.

"SNP has a risk identification committee that meets monthly to ensure all external resources are delivered in compliance with contractual service level agreements," their spokeswoman said.

"This committee is comprised of members of both the leadership team and operational teams and is chaired by SNP's National Risk and Compliance Manager."

She noted SNP still had no formal notification that any of its subcontractors were under investigation.

"However if this changes we will act on it accordingly," she said.
