The national broadcaster is challenging the validity of the search warrant in the Federal Court and is seeking the return of documents seized by the AFP during the June 5 raid.

The material seized related to a 2017 report called The Afghan Files, which relied on leaked defence documents.

The broadcaster's challenge to the warrant is due to be heard in the Federal Court over three days from October 28. The ABC will argue it was "legally unreasonable" for the AFP to seek a search warrant in the circumstances and for the Local Court to issue it.

In a preliminary round on Monday, the broadcaster sought to amend its case to widen the range of allegations made against the federal police and the Local Court registrar who issued the warrant.

This included an allegation that the decisions to seek and issue the warrant were "affected by jurisdictional error" because neither party took into account a range of "relevant considerations", such as "the very significant intrusion of privacy that the search warrant purported to authorise", "the importance of the protection of [journalists'] sources", and "the public interest in investigative journalism".

But in a decision on Monday, reasons for which were published on Tuesday, Justice Wendy Abraham rejected the ABC's bid to amend its case to include those allegations.

Justice Abraham said the claims were "speculative at best" and "the only basis on which to allege that these public policy considerations were not taken into account was the fact that the warrant was issued and sought".

"The ground is premised on the correctness of that proposition," Justice Abraham said. "In other words, there is no other basis to support the inference that the considerations were not taken into account."

Justice Abraham also rejected as a "fishing expedition" an attempt by the ABC to compel the other parties to produce documents relevant to those claims, under a legal process known as discovery.

She said that making the "bare allegation" that there had been a failure to take into account public policy considerations that ought to have been taken into account did "not entitle [the ABC] ... to any documentation from which it might determine what considerations were taken into account".

The ABC's case includes allegations the decisions to seek and issue the search warrant were "legally unreasonable" because, having regard to public policy factors such as privacy, the protection of sources and the public interest in investigative journalism, "no reasonable person" in the position of the AFP or the Local Court registrar would have made the decisions.

Those claims are unaffected by Justice Abraham's decision.

The AFP has given a temporary undertaking not to access the documents seized, which are being held in sealed envelopes, until the conclusion of the court case.

Justice Abraham's decision sets out a timeline of events, including that the AFP contacted the ABC on January 24 this year "about the possibility of conducting a search of the ABC's premises".
