Fern Messenger sought the order, claiming an email sent by the Burnie-based senator in January caused her a mental injury.

In June, Senator Lambie's lawyer Glynn Williams called the proceedings surrounding the order a "circus" and sought to have it dismissed.

But on Wednesday, Magistrate Tamara Jago refused the application and set a date for a hearing into the matter in December.

However, she issued a warning to Ms Messenger about the amount of complex legal work she had ahead of her if she chose to proceed, particularly unrepresented.

"It seems to me you have quite a lot of work to do if you want to pursue this application," Ms Jago said.

"The longer this goes on the less likely you are going to be able to satisfy the court of the legislative requirements."

She drew attention to evidence of witnesses which will need to be presented at the hearing, which Ms Messenger said will be presented by her psychiatrist.

However, Ms Jago was at pains to explain to Ms Messenger that a person she claims is her psychiatrist cannot simply appear via telephone call to a court hearing.

"You have to satisfy the court that the evidence is going to be admissible.

"The court has no way of knowing that unless you file a proof of evidence or an affidavit from the psychiatrist.

"The psychiatrist will then have to be available for cross examination."

Mr Williams indicated there will be "wholesale opposition" to any witnesses called by Ms Messenger, as "the respondent's position is that there are no witnesses", he said.

Ms Messenger then mentioned she intended to rely on tendency evidence, before Ms Jago cut her off.

"I strongly suggest you get some legal advice if you are going down the tendency evidence line," she said.

"It is not my role to give you legal advice. I have tried to be as fair to you as possible. It is simply not fair to the other parties."

Ms Messenger then sought to table a letter to the court, which she described as a pre-trial issue at the insistence of her husband.

She said that due to her mental health injuries, she sought leave to allow her husband to speak for her at times during the hearing.

"I want my husband to be able to speak for me if I lose it," she said.

Ms Jago said that application would require further consideration closer to the hearing, and Mr Williams said it was "fundamentally opposed".

Ms Jago adjourned the matter for a mention date on December 1, and allocated a full day on December 4 for the hearing.
