The first at the federal election this weekend, where he is an independent Senate candidate. And the second in court, in a fight against bankruptcy proceedings brought against him by the territory's peak legal body.

The ACT Law Society filed to have Mr Ezekiel-Hart declared broke after he failed to pay it court-ordered legal costs arising from a series of lost cases.

The solicitor unsuccessfully attempted to sue the Law Society, claiming it conspired to deny him the chance to start his own law firm. Fairfax Media believes he owes the organisation about $100,000 in costs.

It is highly unlikely Mr Ezekiel-Hart will be elected to the Senate. But if he is and then declared a bankrupt he would automatically lose his place in Parliament.

Under section 44 of the constitution, undischarged bankrupts cannot sit as members of the House of Representatives or Senate.

This would put the ACT Legislative Assembly in the unusual position of having to find and elect another independent to fill the remainder of the Senate term.

But the 49-year-old said he would not jeopardise his seat if he pulled off a stunning victory this weekend. ''If I win the election, I have two options. Either I will continue with the case and, as I anticipate, justice will be done,'' Mr Ezekiel-Hart said.

''Or I pay the money before the court decides to make a decision. There is nothing to lose at this stage because I have a choice.''

The poll is Mr Ezekiel-Hart's second tilt at public office, after an unsuccessful bid for the ACT Legislative Assembly in October last year.

He attracted only 589 votes in Ginninderra, but was encouraged by finishing as the most popular ungrouped independent in the electorate.

Mr Ezekiel-Hart said the bankruptcy proceedings had not damaged his election campaign. ''If it had, I wouldn't even run as a candidate. There is no distraction at this stage, I am on course.''
