But Halafihi "Fihi" Kivalu must provide the court with a $30,000 security and his wife's passport first.

Magistrate Peter Dingwall also eased Kivalu's curfew conditions to allow him to attend church and community events three nights a week.

Kivalu is currently on bail from the ACT Magistrates Court on two counts of blackmail.

He has pleaded not guilty.

He is accused of collecting about $200,000 in cash from about six people when he worked as a Construction, Forestry, Mining and Energy Union official, allegedly telling one contractor that if he did not pay, a job would go to a rival firm.

Kivalu allegedly collected some payments in $10,000 increments between March 2012 and May 2013 after the contractor then won a job.

In late 2013, the contractor allegedly enlisted Kivalu's help when he believed he had been targeted by the union after he won a job on a Braddon project.

During one phone call, the defendant allegedly said: "Look, I sorted it, but you are going to have to give me some money … give me some money to get some people off your back."

The pair allegedly agreed on a price of $20,000, with the contractor believing he had no choice, or he would continue to face the threat of job sites being shut down.

Court documents also said phone intercepts heard Kivalu and the contractor, and the defendant and his wife, discussing the payments.

On Friday, Kivalu asked the ACT Magistrates Court for permission to travel to New Zealand as part of his work for a labour hire company.

Defence lawyer, Toni Tu'ulakitau, told the court his client would leave fly out on Sunday and return mid-next week.

A letter from Kivalu's employer, airline tickets, and proposed travel itinerary was tendered as part of the application.

The matter was adjourned for some hours after Mr Dingwall asked about a surety from Kivalu's employer.

After investigations, Mr Tu'ulakitau said Kivalu could offer his house as security and his wife's passport.

The prosecution said Kivalu had strong business and family ties to New Zealand and Tonga.

But Mr Dingwall pointed out that Australia had extradition treaties with New Zealand.

Mr Dingwall said Kivalu had significant ties to Australia, with a wife and two children, property, and job.

The magistrate said this was a strong incentive to return to Australia, but the court would impose further inducement in the form of a $30,000 security.

Mr Dingwall said the $30,000 would be sufficient to cover the cost of extradition if Kivalu did not return from the trip.

The magistrate also ordered the wife of the accused surrender her passport to the court.

Kivalu will be required to give his passport back to the court when he returns next week.

The matter will return to court for committal next month.
