Vytas Bronius Kapociunas, 71, an artist and sculptor, went on trial in the ACT Supreme Court on Friday for allegedly molesting the child three times in one day in Spain.

The girl has told police one of the alleged acts occurred when Kapociunas carried her to his studio to get drawing material, and then took her into a bedroom.

Kapociunas and his wife Jane Hardy, then ambassador to Spain, returned to Australia voluntarily after the allegations were made.

The accused was interviewed by police and denied he had ever sexually abused the girl.

He said he had piggybacked her and was tickling her in a bedroom, before blowing raspberries on her stomach.

Kapociunas is charged with

"I got used to it so it doesn't make me feel anything because he does it every time," she said.

She then spoke of being molested in a bedroom three times in one day, the acts for which Kapociunas is charged.

On the third occasion, she said Kapociunas told her she was "beautiful".

The Crown, represented by Carolyn Davenport, SC, told the jury the girl had said nothing about the alleged acts immediately afterwards.

"She said nothing, she said nothing to her father. She said nothing to anybody about the incidents," Ms Davenport said.

But she said she told her mother she "had a secret" as she was being put to bed, and then told her of the allegations.

When police asked her why she felt like she couldn't tell anyone, the girl replied:

"I just felt like it had to be kept a secret. I don't really know why."

Ms Davenport said the prosecution also needed to prove Kapociunas was an Australian citizen and that the offence occurred outside Australia, elements that would not be in contest.

"The only issue, is whether in fact the Crown satisfies you beyond reasonable doubt that the conduct occurred," she said.
