Scott Michael Dixon, 30, was allegedly suspicious that his girlfriend was cheating on him in December last year.

He is accused of saying "it's not even my f---ing kid" and punching her three times in the stomach.

Dixon was allegedly contravening a protection order taken out by the woman at the time.

There is no medical evidence of any injury to the baby, the court heard.

Dixon has pleaded not guilty to two charges and is preparing to go to hearing in the ACT Magistrates Court. Another two back-up charges of common assault were laid on Tuesday.

He has been subject to strict bail conditions preventing him from being in the ACT or contacting the complainant.

He appeared in court on Wednesday to apply to vary those bail conditions so he could be present for the birth.

The court heard that the woman had given him permission to be there, but the prosecution opposed the move, pointing to the seriousness of the alleged crimes and the risk he posed to the woman.

The prosecutor said Dixon had a lengthy criminal history, which included a previous assault on the same woman.

She said the woman had previously had a miscarriage after an assault by Dixon.

Magistrate Robert Cook said he was "entirely in the hands of the complainant" and altered Dixon's bail to allow him to visit the hospital during the birth, if he obtained her permission.

He also changed the bail to allow Dixon to enter the ACT for work and for his son's medical procedure.

The case will come back to court next month.
