Kyall Green, 22, was fatally injured when the car he was travelling in rolled at the intersection of Cannan Crescent and Constance Stone Street, Macgregor, in January last year.

Thomas Robins, 23, is on trial in the ACT Supreme Court accused of culpable driving occasioning death.

He has pleaded not guilty.

The Crown alleged the accident was caused by a combination of Robins' intoxication and being distracted by his passengers.

The defence admitted its client returned an alcohol reading of .066, the car had been mechanically sound, the weather had been clear, the road surface dry and smooth and the road well lit.

But defence barrister James Lawton argued Robins' actions fell short of the the definition for culpable driving, which required a jury to find that a defendant, to a gross degree, failed to take the standard of care that a reasonable person would have observed in the same circumstances.

Robins and Mr Green had been drinking at a party in Higgins on Sunday, January 20.

A group of four decided to travel the short trip to Robins' Macgregor home in his work Mitsubishi Triton utility, with the accused behind the wheel, Mr Green in the passenger seat, and two men in the tray.

The court heard Mr Green partially climbed out of the ute's window to take photos on his phone of the men riding in the tray.

The Crown said Robins became distracted by the trio and was travelling too quickly when the vehicle entered the intersection at about 12.45am.

The ute rolled and Mr Green was crushed.

He died the following afternoon.

The court on Monday heard from a crash investigator who estimated the car had been travelling at about 36km/h, the vehicle's "flip speed", when it entered the intersection.

Justice John Burns gave jurors final directions before sending them to deliberate at about 4pm on Monday.

They will reassemble and continue deliberations on Tuesday morning.
