Adam Pearce, 31, and Naomi Leslie Breasley, 42, were each charged with trafficking methadone and heroin and possessing a prescription-only drug, Naloxone Hydrochloride.
The prosecutor opposed Pearce’s application for bail but Magistrate Peter Dingwall found there was ‘‘precious little evidence’’ that could suggest Pearce would commit further offences.
The police statement of facts alleged the heroin had been found in the woman’s handbag.
While drug paraphernalia - such as balloons, two digital scales and clipseal bags - had been found at the house when it was searched by police at about 5am Friday morning, the magistrate noted Pearce, who receives a carer’s payment from Centrelink, was not the only occupant of the house.
‘‘One presumption that always applies [in the application for bail] is innocence,’’ Magistrate Dingwall said.
‘‘Where is the evidence here that he is a user or has been trafficking drugs?’’
Pearce will appear in the ACT Magistrates Court again on November 27, while Breasley will be in court on November 29 after she did not apply for bail.
