Canberra man accused of raping teen after night out to stand trial

Kerry Roy Bye, 24, pleaded not guilty to three counts of sexual intercourse without consent, committing an act of indecency without consent, and second degree sex assault in the ACT Magistrates Court.

He was behind bars after a magistrate denied him bail on Saturday for returning to the same nightclub in breach of his bail conditions.

Court documents, filed during a bail hearing late last year, said Bye offered to call a taxi to help a woman outside a nightclub after he saw her vomit several times one night in November.

He then allegedly took the woman, 19, back to his Cook home in a taxi.

She allegedly awoke later to him sexually assaulting her and tried to resist.

Bye is then alleged to have held her by the throat so she could not breathe until she stopped resisting and said: "Are you going to be good?"

Court documents said he later hit her in the head twice, called her a "slut" and "bitch", pulled her hair, and told her he enjoyed it when she screamed at him to stop.

She allegedly managed to escape after one of the defendant's friends knocked on the door and ran from the premises wearing nothing except her socks.

The woman told the friend that Bye had raped her and he went back to the unit to get her clothes.

A passerby stopped to help as she waited and later drove her home.

Bye allegedly told the friend that the pair had not had sex as he had interrupted them.

Court documents said a medical examination of the woman revealed numerous injuries consistent with sex.

Magistrate Beth Campbell on Wednesday committed Bye to stand trial for his alleged crimes in the Supreme Court.

He did not speak during his brief appearance in the court and did not apply for bail.

Defence lawyer Toni Tu'ulakitau indicated his client would likely make an application for bail in coming weeks.

He was remanded in custody.

The matter will next be mentioned in the higher court on April 28.
