The council this week decided not to continue its application for an ACT Civil and Administrative Tribunal review of the Planning and Land Authority's decision to green light the project.

The withdrawal of the challenge ends an almost three-year saga for the project, which has undergone amendments and several challenges during its application phase.

Construction will be able to begin as soon as Icon Water, the Territory and Municipal Services Directorate and the ACT Heritage Council give the plans their final endorsement.

All three organisations expressed concerns over aspects of the project during the application stage, with the ACT Planning and Land Authority making its approval conditional on a final sign-off from the agencies.

North Canberra Community Council chairman Mike Hettinger said typographical errors in the decision made it appear the Planning and Land Authority deemed the development to be "inconsistent" with the Territory Plan, when the opposite was the case.

He said the council considered further investigating the project's consistency with the Territory Plan, but "concluded that it did not have the resources to do so".

The rubbish removal issues were being discussed with Territory and Municipal Services, while the number of residential units proposed has dropped from the initial proposal of 160 to 156.

"Our concerns arising from the Braddon Club saga remain," Mr Hettinger said. "Clubs that opt to deconcessionalise their leases will continue to make windfall gains in a process that is neither transparent nor accountable."

The development, which will border Cooyong, Donaldson and Torrens, will include 156 residential units, office space and room for both retail and restaurants.

The council's appeal to ACAT argued the approval appeared to breach planning codes, permitted the "unnecessary" removal of trees and limited community space for surrounding residents.

It also claimed the plans did not include an adequate solution for waste removal and included apparent inconsistencies with the Territory Plan.

Both parties went into mediation on March 3, after which the council was given a week to inform ACAT whether or not their application would proceed.

The council decided not to continue with its challenge before the deadline, meaning no further action will be taken at ACAT.

Its previous challenge against the plan was defeated in 2014, when ACAT ruled that removing the concessional status of the land's lease was valid.

The development was proposed as a way of diversifying Raiders Group's revenue streams, after the Braddon Club closed due to financial difficulties in 2013.

The site is currently used as a carpark.
