ACT Policing said they first stopped the man at 11.30pm on Tuesday, August 15 for a random roadside breath test, which returned a 0.125 reading.
The man was already a disqualified driver, police said, and subject to a blood alcohol limit of zero.
He was then charged with driving whilst disqualified, driving under the influence and was given a court date. His bail was on condition he did not drive a car.
But police later stopped the same man at 5.40am on Wednesday morning with a breath test revealing a blood alcohol level of 0.029.
The man was arrested and taken to the ACT Watchhouse and charged with breaching bail conditions.
