Prosecutors did not pursue one drug trafficking charge and a charge of possessing property suspected to be stolen, while a second charge of drug trafficking was found not proved.

Benjamin Charles Dumbrell was in the driver's seat of a BMW in the Gungahlin Lakes Club carpark - with another man in the passenger seat - when police approached about 10.35pm on June 5, 2017.

It's alleged an officer said: "What are you doing here?"

Mr Dumbrell: "Just having a smoke."

"But you aren't smoking, where are your smokes?"

"Um, I don't know"

"Why not just smoke in the smoking area of the club?"

"Um, because people drink in the club."

Officers suspected there may have been drugs in the BMW, "due to the nervous behaviour of the defendant, the odd reason for them being in the vehicle, the presence of plastic clip seal bags, and [the second man] stating he had cannabis on his person", police allegations tendered to the court said.

When they searched the car, police allegedly found four grams of cocaine, 8.4 grams of methylamphetamine and a homemade "conducted energy weapon". They also found nearly $3000 in cash alleged to be the proceeds of a drug deal, as well as a glass smoking implement, clipseal bags and a set of small digital scales.

Mr Dumbrell was arrested and taken to Gungahlin Police Station.

He appeared in the ACT Magistrates Court on Monday, June 6, 2017 when the 30 year old applied for bail through a Legal Aid duty solicitor.

The solicitor told the court Mr Dumbrell denied knowing about the drugs or homemade Taser and had been shocked when police closed the door and activated the weapon in the driver's side panel.

He said the car did not belong to him and the cash was winnings from the pokies that night, for which he had receipts, she said. He had gone outside for a smoke, but got into the car because it was cold.

Mr Dumbrell was searched at the police station after his arrest, and officers allegedly found about 0.2 grams of a white crystalline substance suspected to be ice in his right shoe.

When questioned by Magistrate Robert Cook about these drugs, the solicitor said she had been instructed they were for personal use.

The man has been charged with trafficking drugs, possessing a prohibited weapon and possession of property suspected to be proceeds of crime.

Mr Dumbrell was formally refused bail. No pleas were entered.
