'I had no choice': Neoni Lee Banks faces trial accused of shooting partner

Neoni Lee Banks, 42, was charged with attempted murder after the early morning incident at the couple's Kings Highway property.

Her trial began in the NSW District Court this week.

Police were called to the property at about 3am on August 9, 2015, where the first officer on the scene found Banks "choked up" and making signs around her throat, the court heard.

Led by Crown prosecutor Chris Todd, the officer said after following the sound of groans through the house, she saw Banks' partner kneeling at a bed with a wound to his back.

The officer arrested Banks and gave a warning about her rights. The couple's child, who was in the room with Banks, was later taken to Queanbeyan police station.

"I had no choice," the court heard that Banks said in those moments.

The court heard that later the man told police they had fought, and he had been sleeping in the spare room, when he heard noises.

The victim allegedly said he left the room to find Banks with one of their guns. It's alleged he said if she was going to shoot him she'd have to shoot him in the back and he turned around.

Later at the hospital he allegedly told his mother, who also gave evidence on Wednesday, that he had earlier put his hands around Banks' neck to "lift" her out of the room after they had fought.

The court heard they fought about whether he had visited dating sites.

Photos tendered to the court showed holes in the walls of the house from a bullet that had travelled through the master bedroom and into their child's bedroom, and through the child's bedroom door.

The photos showed rooms around the house, including the kitchen.

Under cross-examination by defence barrister Grant Brady, SC, the officer in charge of the investigation said she had not noticed whether or not a knife was missing from the knife block in the kitchen.
