Vytas Kapociunas, 71, has been on trial in the ACT Supreme Court over allegations he sexually assaulted the girl three times in one day at his Spanish home.
The child is said to have spoken of Kapociunas' actions to her mother that night, indicating to her that he had kissed her in her groin area.
Kapociunas, who was in Spain as the husband of Australian ambassador Jane Hardy, has strongly denied the allegations.
He said he had blown a raspberry on the child's stomach, but never sexually assaulted her.
Chief Justice Helen Murrell summed up the case to the jury on Tuesday morning, before they were sent out to begin deliberations.
The jury asked to go home just before 4pm, and will resume deliberations on Wednesday.
