A Thai man charged with the murder of former St Edmund's College student Luke Mitchell has lost his appeal to avoid extradition to Australia.

Sarud Seehaverachart, 31, had appealed against a criminal court's verdict in November 2011 which said he and his co-accused Thatiya Terdputham had to face an Australian trial for Mr Mitchell's bashing and murder in 2009.
Mr Mitchell died after intervening in a fight and being stabbed outside a 7-Eleven store in Sydney Road, Brunswick, in the early hours of May 24 that year. The two co-accused were students in Australia at the time of the death, and allegedly fled to Thailand a short time after Mr Mitchell, 29, was stabbed.
They have pleaded not guilty to murder, saying they fought in self-defence. A third man linked to the death also fled to Thailand and is still on the run.
Terdputham withdrew his appeal against extradition and was returned to Australia in July where he is in custody until his next court hearing, but Seehaverachart had requested to be tried in Thailand. Thail appeals court judges said the men were expected to receive justice and the same treatment as other suspects in Australia.
