Michael Wayne Clark, son of Canberra Rebels Outlaw Motorcycle Club president Wayne Gordon Clark, was this morning sentenced to 12 months for the incident.

The south coast tattoo shop operator will serve half the sentence in periodic detention, with the remainder suspended on entering an 18-month good-behaviour order.

Justice John Burns handed down the sentence earlier today in an ACT Supreme Court courtroom packed with family members, bikies and club associates.

Clark, 26, had initially been charged with intentionally inflicting grievous bodily harm, and pleaded not guilty, over the events of September 2009.

But an agreement was eventually struck between the Director of Public Prosecutions and the defence lawyers, with Clark pleading guilty to the less serious charge of culpable driving by negligence causing grievous bodily harm.

The new indictment meant there was no longer any suggestion Clark intended to injure his victim, and the judge had to proceed on the assumption it was an accident.

On the morning in question the victim had just returned to his home in Kambah after taking his dog for a walk with a friend, according to the statement of facts.

The friend had fallen behind the victim, who was at the bottom of his driveway, when he heard a car speeding up behind him.

As the victim walked up his driveway the Toyota Hilux, with Clark behind the wheel and another man in the passenger seat, turned sharply to the right.

"Despite not having a clear view of the driveway [because of a tall row of shrubs] and of any vehicles or persons standing in it, the accused drove into the driveway," the document states.

It is estimated Clark was going at about 20-30km/h when he struck the victim.

The injured man was pinned between the Hilux and the parked Commodore with enough force to push the Holden into a set of metal gates across the driveway.

He suffered a fractured skull, seven broken ribs and had some of his teeth knocked out among other injuries.

The victim's spleen was later removed.

He has since recovered significantly but has not worked since his release from hospital in October 2009.

In the aftermath of the incident the victim told police he had been in dispute with the bikie club because he failed to return his motorcycle when he left the group.

But Clark told the author of a pre-sentence report he was merely walking his dog, and the fact the victim was in the club's bad books was "purely coincidental".

"It is apparent from all the material put before me that you deliberately turned your vehicle into the driveway of [the house]," the judge said this morning.

"The suggestion which appears to have been made to the author of the pre-sentence report, that the fact that the vehicle hit [the victim]....was purely coincidence, is simply not credible."

Justice Burns said he was satisfied Clark knew the victim was in the driveway, and that the man was in dispute with the club.

"It is probable that you turned into the driveway of [the victim's house] to have words with [the victim] over this dispute," he said.

"Unfortunately when [the victim] entered the driveway you were unable to see him due to the row of tall shrubs referred to in the statement of facts."

But the judge accepted the collision was the result of negligence, rather than intent, and that Clark's decision to turn into the driveway was a spontaneous one, according to the evidence before the court.

Justice Burns accepted Clark had no criminal record at the time of the incident, was now effectively the sole carer for his child and had pleaded guilty.

The court also heard he was assessed as a low-risk of reoffending.

At the time of the incident the maximum penalty for the offence was just four years, which the judge noted was less than other jurisdictions and less than for the charge of assault occasioning actual bodily harm.

Last year the Legislative Assembly, prompted by a push from the families of car crash victims and DPP Jon White, increased that penalty to 10 years.

But the previous four-year maximum still applied in the Clark case.

"In my opinion, nothing less than a term of imprisonment would be appropriate to reflect the objective seriousness of the offence and to deter those who might be minded to drive in a similar manner," Justice Burns said today.

The judge, however, said it was appropriate for Clark to serve the sentence partially in periodic detention, with the remainder suspended.

He has also been disqualified from driving for six months.
