Stalker who masturbated in front of woman sentenced to prison

A sentencing hearing at ACT Magistrates Court on Wednesday was told Jason Bailey, 46, repeatedly targeted the victim over a number of weeks with his unwanted sexual advances.

Bailey, who pleaded guilty to charges including stalking and acts of indecency, had a history of sexual offending, the court heard.

Prosecutor Jan De Bruin said he first approached the woman at an ACT caravan park to ask for some milk.

A few weeks later the victim was walking near her unit and saw Bailey standing nearby completely naked and masturbating, staring at her.

The next week, Bailey was seen standing in his unit masturbating and staring at least once a day, the court heard.

Bailey left the victim two notes on separate occasions, one of which explained in graphic details his sexual urges directed to her.

Bailey was arrested on September 17 after police were called to the park.

Defence counsel Bridgett Dunne said Bailey accepted a prison sentence was inevitable.

She said he was in the middle of an "ice binge" at the time of the offending.

"He was in his words, 'out of his mind'," Ms Dunne said.

She said Bailey believed at the time the victim was "receptive to his advances" but now understands that was not the case.

Ms Dunne said his offences could be considered "less severe" than if he had been in close proximity to the victim.

Mr De Bruin said it was possible other people in the precinct had witnessed his conduct.

"It would have caused significant angst to the victim," he said.

Magistrate Bernadette Boss said it must have been a daunting and frightening experience for the female victim.

"The community is to be protected from this type of behaviour," she said.

"[She] couldn't be safe from your behaviour in her own home."

Dr Boss sentenced Bailey to 18 months' prison, six months of that sentence to be suspended.
