More than 1000 people signed a petition asking for a change to Queensland civil liability laws, so the driver would automatically be assumed to be at fault in crashes between a motorist and vulnerable road users, such as cyclists.

The onus would be on the driver's insurance company to prove the cyclist caused the crash.

But Main Roads Minister Mark Bailey said the government was not considering changing the law.

Mr Bailey said Queensland Police Service crash data showed the bicycle rider was at fault 41 per cent of the time in serious crashes involving a motor vehicle and a bicycle between 2012 and 2016.

"Given cyclists are at fault in a significant portion of accidents, albeit fewer than motorists, reversing the onus of proof may impact upon a court's ability to consider the specific circumstances of a crash and apportion liability fairly," he wrote in response to the petition.

"Issues of liability of the different parties in a crash are, therefore, likely to be best left to the legal process, without a reverse onus of proof being introduced."

Mr Bailey said currently, the person bringing a civil case bore the onus of proving the cause of the crash.

"This reflects a long-standing principle in our legal system," he said.

"Amending the legislation to place the presumption of liability on a motorist would reverse that onus of proof."

But Bicycle Queensland chief executive Anne Savage said all the evidence, not just serious crash data, should be considered.

"The fact remains that drivers are at fault in at least 80 per cent of all road crashes involving a cyclist and a motor vehicle," she said.

A Monash University Accident Research Centre study found drivers were at fault in 87 per cent of incidents with cyclists, while a Royal Automobile Association of South Australia found the cyclist was not at fault in 70 per cent of crashes, and Adelaide University's Centre for Automotive Safety Research found four in five crashes between cars and bicycles were caused by the driver.

Ms Savage said there were several examples in the legal system where the onus of proof was reversed to improve the carriage of justice.

That included a bill currently before the Parliament to create executive officer liability for major safety offences under the Heavy Vehicle National Law.

Ms Savage said there were excellent systems in place to allow motorists to prove the liability of the other party if cyclists were partially or fully at fault.

And Ms Savage said the whole Queensland community paid a high price for motor vehicle insurance claims.

"We would welcome a balanced discussion about how to get better outcomes for everybody," she said.

"We have concerns about the high cost of legal and investigation fees for all crash victims and the rising costs of insurance premiums for drivers and riders.

"Presumed-liability laws would in all likelihood bring overall costs down and improve road safety."

Ms Savage said presumed-liability laws were in practice in many countries, including New Zealand, India, China, France, Denmark, the Netherlands and Italy.
