ACT Construction Occupations Registrar Ben Green commenced the proceedings with the Director of Public Prosecutions laying four charges against TP Dynamics and Madison Constructions.

TP Dynamics is behind the Wish Development in Bruce and Madison Constructions built the Kelkiah Apartments in Macquarie.

On Monday, TP Dynamics were served summons for four alleged breaches of ACT building legislation.

Mr Green said the breaches related to allegations the company began building without the required approvals in place.

"We allege that the required approvals were not in place, which is a fundamental requirement that underpins the integrity of the building and development system," Mr Green said.

"We know that the purchase of a residential property is one of the largest investments a citizen can make and they should be confident that the approvals required are in place and are being complied with."

TP Dynamics allegedly began construction work at the Thynne Street, Bruce development between February and May. The development includes 56 townhouses, 12 terraces, commercial spaces and a basement car park.

Access Canberra directed a stop work notice on the developer in May once the unapproved building was discovered.

The four charges against TP Dynamics over the Wish Bruce development have a combined maximum penalty of more than $3 million.

Mr Green said the allegation against Madison Construction was that the company failed to comply with a rectification order to fix a number of building defects at the Kelkiah Apartments.

The order placed on the company required it to prepare a program of works and detail methods for fixing the defects.

The defects related to facade and ceiling cracking and waterproofing.

The maximum penalty for failing to comply with a rectification order is $1.6 million.

Both matters will appear in the ACT Magistrates Court on November 6.
