Justice Michael Elkaim on Wednesday sentenced Sunil Batagoda, 62, to seven years jail, with a five year non-parole period.

The judge backdated the sentence to take into account time spent in custody, meaning Batagoda will be eligible for release in 2022.

In jailing Batagoda, Justice Elkaim found the offender had taken advantage of the victims in order to obtain sexual gratification for himself.

Batagoda pleaded guilty in the ACT Supreme Court to four counts of sexual intercourse with a person under 16 and one count of committing an act of indecency in the presence of a person under 16.

Batagoda offered to give the girls a lift after he met them at the Civic bus interchange - where one asked for money to catch a bus – in August 2016.

Over the next seven months the man would buy the girls alcohol, marijuana and cigarettes, give them cash, and would pick them up and drive them around.

Batagoda forced two of the girls to have sex with him, and a third teenager to perform oral sex.

A fourth girl, woke up to discover Batagoda masturbating and touching her breasts.

However, the court heard, Batagoda had sought to minimise the seriousness of his actions as he believed the teenage victims to be promiscuous.

Justice Elkaim said Batagoda's attitude to the offences had been "of some concern".

"The offender has sought to minimise his involvement and, to some degree, pass on the blame to the victims," the judge said.

"The perceived promiscuity of the victims is irrelevant. They were 14 to 15 years of age."

At sentence hearing, Batagoda's defence lawyer had submitted the precociousness of the victims in seeking out favours should also be taken into account.

Justice Elkaim disagreed.

"The evidence overwhelmingly demonstrates that the offender made a concerted effort to befriend the victims, ply them with cash, alcohol and drugs and then effectively extort sexual favours from them.

"The offender took advantage of the victims and obtained sexual gratification from them.

"In my view, the offences are objectively serious."

During Wednesday's sentence, the court heard Batagoda - who had no criminal history – had allegedly been the target of a vigilante attack as a result of the offences.

Batagoda's defence submitted the court should take this into account upon sentencing.

However, Justice Elkaim found it would be "inconsistent" and "unjust" to hand down a more lenient sentence as a result.

"The important point is that the three accused visited the residence as a result of the offender's appalling criminal conduct.

"It would, arguably, be an inconsistent and unjust consequence if the offender were to obtain some leniency for ... this matter."
